Chicago’s First District recently decided to approve two liens submitted by small construction companies, even with some inaccuracies made in the claim.
According to the article “Contractors’ Honest Mistake in Lien Completion Date And Amounts Doesn’t Doom Mechanic’s Lien Case (IL Law)” written by Paul Porvaznik, two relatively small construction companies made mistakes when completing their mechanics lien claims, but proved to not be fatal to the cases. These mistakes included an improper completion date and overemphasized lien amount. The courts decided that since these companies had filed their liens in a timely manner, have limited resources and were filing lien claims for the first time, their inaccurate details would be considered honest mistakes.
